Welcome to ProofList. These Terms of Service ("Terms") govern your access to and use of the ProofList website and services at proof-list.com. By using our services, you agree to be bound by these Terms.

1. Services Description

ProofList provides an AI-powered inventory documentation service. Users upload photos of their belongings, and we generate detailed spreadsheets with item descriptions, categories, and estimated replacement values. Our services are designed to assist with insurance claims, estate planning, and personal record-keeping.

2. Account Registration

To use our services, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account
• Be at least 18 years old

3. Acceptable Use

You agree not to use our services to:

• Upload content that is illegal, fraudulent, or infringes on others' rights
• Submit false or misleading information for insurance fraud
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Upload malicious files or code
• Use automated systems to access our services without permission
• Resell or redistribute our services without authorization

4. Pricing and Payment

Our pricing is based on the number of photos processed. Current pricing is displayed on our Pricing page. By making a purchase, you agree that:

• All prices are in US dollars
• Payment is due at the time of purchase
• You authorize us to charge your payment method
• Prices may change, but changes won't affect existing orders

5. Free Trial

We offer a free trial allowing you to process up to 25 photos at no cost. The free trial is limited to one per user/household. We reserve the right to terminate accounts that abuse the free trial.

6. Refund Policy

Due to the nature of our service (immediate processing of photos), refunds are generally not available once processing has begun. However, we may offer refunds or credits at our discretion in cases of:

• Technical failures that prevent delivery of your inventory
• Significant service issues that we cannot resolve
• Duplicate charges or billing errors

To request a refund, contact us at support@proof-list.com within 14 days of your purchase.

7. Valuations and Estimates

You acknowledge and agree that:

• Valuations are estimates based on available market data
• We do not guarantee the accuracy of any valuation
• Values may differ from insurance company assessments
• You are responsible for verifying and adjusting values as needed
• ProofList is not a licensed appraiser or insurance adjuster

8. Intellectual Property

Your Content: You retain ownership of all photos and content you upload. By uploading content, you grant us a limited license to process, store, and display your content solely for providing our services.

Our Content: The ProofList website, branding, software, and generated inventory formats are our intellectual property. You may not copy, modify, or distribute our materials without permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ProofList is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid for the specific service giving rise to the claim
• We are not responsible for insurance claim outcomes or disputes with insurance companies
• We are not liable for data loss, though we take reasonable precautions to prevent it

10. Indemnification

You agree to indemnify and hold ProofList harmless from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

11. Service Availability

We strive to maintain continuous service availability but do not guarantee uninterrupted access. We may temporarily suspend services for maintenance, updates, or circumstances beyond our control. We reserve the right to modify or discontinue services with reasonable notice.

12. Account Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms or engage in fraudulent activity. Upon termination:

• Your right to use our services ends immediately
• We may delete your data according to our retention policy
• Provisions that should survive termination will remain in effect

13. Dispute Resolution

Any disputes arising from these Terms or your use of our services will be resolved through binding arbitration, except where prohibited by law. Before initiating arbitration, you agree to attempt to resolve disputes informally by contacting us.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through our website or by email. Continued use of our services after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
